Acknowledgment of Risk and Waiver of Liability

In consideration of the risk of injury while participating in yoga, breathwork, or related wellness activities (collectively referred to as the “Activity”), and in exchange for the right to participate in the Activity, I, the undersigned participant, hereby knowingly and voluntarily enter into this waiver and release of liability. For myself, my heirs, executors, administrators, assigns, or personal representatives, I waive and release any and all rights, claims, or causes of action of any kind whatsoever arising from my participation in the Activity.

I hereby release and forever discharge Jacob Meyers, Heather Meyers, Bikram Yoga Nicaragua, Playa Marsella, Residential & Vacation Rentals, Mango Rosa, Rivas NI, San Juan del Sur 48600, along with their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and assigns, from any physical or psychological injury (including but not limited to illness, paralysis, death, damages, economic or emotional loss) that I may suffer as a direct or indirect result of my participation in this Activity, including traveling to and from any event related to this Activity.

Assumption of Risk

I understand that I am voluntarily participating in this Activity entirely at my own risk. I am aware that participation may include risks such as physical or psychological injury, pain, suffering, illness, dehydration, overheating, fainting, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, or death. These risks may arise from my own or others’ negligence, the conditions of the facilities, or travel to and from the Activity. I fully assume all related risks, both known and unknown, of my participation.

Indemnification

I agree to indemnify and hold harmless Jacob Meyers, Heather Meyers, Bikram Yoga Nicaragua Playa Marsella, Residential & Vacation Rentals, Mango Rosa, and their affiliates against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation, or otherwise, including attorney’s fees and related costs, brought by me or anyone acting on my behalf.

Health and Safety

I certify that I am in good physical condition and have consulted with a medical professional regarding my participation if necessary. I agree to:

Listen to my body and respect my limits.
Follow the guidance and instructions of the instructor.
Inform the instructor of any injuries, medical conditions, or pregnancy prior to class.

I acknowledge that yoga, including Bikram and other heated or non-heated practices, may involve intense physical exertion in a warm environment and carries inherent risks such as overheating, fainting, dehydration, or muscle strain. I accept full responsibility for monitoring my own wellbeing during the Activity.

Photography and Videography

I understand that classes, events, or workshops at Bikram Yoga Nicaragua Playa Marsella may be recorded, photographed, or filmed for promotional and marketing purposes. By attending and participating, I grant permission for my image, likeness, or voice to be captured and used by Jacob Meyers, Heather Meyers, Bikram Yoga Nicaragua Playa Marsella, Residential & Vacation Rentals, Mango Rosa, and their affiliates in any media format, including but not limited to websites, social media, digital or print marketing, and other promotional materials, without compensation or further notice.

If I prefer not to appear in any photos or videos, I understand it is my responsibility to notify the instructor or photographer before class begins, and reasonable efforts will be made to respect my privacy.

Medical Treatment and Responsibility

In the event that I require medical care or treatment, I agree to be financially responsible for any costs incurred as a result. I understand that I am encouraged to maintain my own health insurance. If any damage to property, facilities, or equipment occurs due to my or my family’s actions, neglect, or recklessness, I agree to be held liable for all associated costs.

Release and Governing Law

I acknowledge that this Activity may test my physical and mental limits and carries potential for serious injury or loss. I fully release and discharge Jacob Meyers, Heather Meyers, Bikram Yoga Nicaragua Playa Marsella, Residential & Vacation Rentals, Mango Rosa, Rivas NI, San Juan del Sur 48600 and all associated parties from any and all claims or causes of action arising from my participation in this Activity.

I have carefully read this waiver and fully understand its contents. I voluntarily sign this release as a complete and unconditional release of all liability.

This agreement shall be governed by and construed in accordance with the laws of Nicaragua.

Acknowledgment

By booking or attending a class, I acknowledge that I have read and agreed to the above Waiver and Release of Liability.
